If your workers’ compensation claim is accepted, you are entitled to receive payments because you can’t perform your usual and customary work. We have listed some important information regarding your Lost Time Benefits:
- Lost Time Benefit, or Temporary Disability (TD) is not paid for the first 3-days (waiting period) until the employee has lost 14-days or the employee is hospitalized
- Benefit calculated based on a 7-day workweek
- Benefit check must be mailed no later than 14-days from the 1st day of lost time and every 14-days thereafter
- If TD due is not paid timely, the amount of the late payment must be increased 10% and paid to the employee – if DWC-1 is not signed by the employee there is no penalty (10% increase)
- Paid only when medical evidence is provided
- Paid when no modified or alternative work is available
- Paid until employee becomes permanent and stationary
- For most dates of injury, payments can’t exceed more than 104-weeks within 5-years from the date of injury
- Calculated at 2/3’s of average weekly wages up to a statutory maximum benefit
- Minimum: $182.29/per week (injury date 01/01/2018 & later)
- Maximum: $1,215.27/per week (injury date 01/01/2018 & later)
- Paid every 2 weeks (tax-free)
- Benefit notice (TD start) must be mailed to the employee and all parties on or before the first TD check is mailed
